Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Bova mobile application, the website at bova.live, and related services and features (collectively, "Bova" or the "Service").

In these Terms, "we", "us", and "our" refer to Reactor Studio d.o.o.

By creating an account or otherwise using Bova, you agree to these Terms. If you do not agree, you must not use the Service.

Our Privacy Policy explains how we collect and process personal data and forms part of your relationship with us.

You must be at least 16 years old to create an account or use Bova.

By using Bova, you confirm that:

• You are at least 16 years old.
• The information you provide is accurate and current.
• You have the legal capacity to accept these Terms.
• Your use of Bova does not violate applicable law.

If you use Bova on behalf of a company or another organisation, you confirm that you have authority to accept these Terms on its behalf.

Some Bova features require an account. You may be able to create or access your account using email or a supported third-party sign-in provider, such as Google or Apple.

You are responsible for:

• Providing accurate account information.
• Keeping your account and device secure.
• Not allowing another person to misuse your account.
• Informing us promptly if you suspect unauthorised access.

You may not create an account using another person's identity or provide false or misleading information.

You can delete your account through the app's settings. You may also request assistance through the in-app contact form or at support@bova.live.

Bova is a community-powered sailing information service. Depending on availability and your permissions, its features may include:

• Marina and anchorage information.
• Community occupancy and availability reports.
• Comments, photographs, and other community contributions.
• Destination search and discovery.
• Weather and maritime-condition information.
• Location-based features and alerts.
• Sailing route or adventure planning.
• Crew invitations, membership, and voting.
• Boats, profiles, contribution points, and reliability indicators.
• Notifications and other related features.

Features may differ depending on your device, operating system, location, permissions, account status, and the version of the app.

Bova is an informational and community service. It is not a navigation instrument, emergency service, harbour authority, marina booking service, coastguard service, or professional maritime adviser.

Information available through Bova may be community-generated, estimated, delayed, incomplete, inaccurate, or unavailable. Occupancy can change at any time, and a report does not reserve or guarantee a berth, buoy, anchorage position, or other space.

Weather information, alerts, maps, protection scores, depths, routes, destination details, and other maritime information must not be treated as the sole basis for navigation or safety decisions.

You remain responsible for:

• The safe navigation and operation of your vessel.
• The safety of your passengers and crew.
• Using current official nautical charts and notices to mariners.
• Checking official forecasts and maritime warnings.
• Assessing weather, sea state, depth, shelter, and local conditions.
• Following instructions from harbour authorities, marina personnel, emergency services, and other competent authorities.
• Complying with maritime, environmental, anchoring, and navigation laws.
• Contacting marinas or authorities directly where confirmation is required.

Never delay contacting the appropriate emergency services because of information shown—or not shown—in Bova.

Some features use your device's location, including precise location, and may use location while the app is running in the background where you have granted the necessary permission.

You control location and notification permissions through Bova and your device settings. If you disable a permission, affected features may become limited or unavailable.

Location detection, geofencing, route recording, and alerts may be delayed or inaccurate because of device settings, signal conditions, network availability, battery restrictions, operating-system behavior, or third-party services.

Bova does not guarantee that a notification or alert will be delivered, received, or seen at any particular time.

"User Content" means information you submit through Bova, including occupancy reports, comments, photographs, boat details, profile information, adventure information, votes, and other contributions.

You retain ownership of your User Content.

By submitting User Content, you grant Reactor Studio d.o.o. a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, adapt for technical purposes, display, and distribute that content as necessary to provide, secure, maintain, and improve Bova.

This licence permits us, for example, to:

• Display reports and photographs to other users.
• Resize or compress uploaded images.
• Include reports in destination availability information.
• Process contributions to calculate points or reliability indicators.
• Create aggregated or anonymised statistics.

The licence ends when the relevant User Content is deleted from our active systems, except where:

• Continued retention is required by law.
• Limited copies remain temporarily in backups.
• The content must be retained to investigate fraud, abuse, security incidents, or legal claims.
• Information has been irreversibly anonymised or aggregated so that it no longer identifies you.
• Another user has independently included the content in their own lawful contribution.

You are responsible for your User Content. You confirm that you have the necessary rights and permissions to submit it and allow us to use it as described in these Terms.

You must not submit content or use Bova in a way that:

• Is false, deliberately misleading, fraudulent, or fabricated.
• Impersonates another person or misrepresents your identity or authority.
• Is unlawful, threatening, abusive, harassing, hateful, discriminatory, or obscene.
• Encourages dangerous or unlawful maritime activity.
• Infringes privacy, copyright, trademark, image, or other rights.
• Shows an identifiable person without an appropriate legal basis or permission.
• Reveals another person's sensitive information or location without permission.
• Contains malware, malicious code, spam, or unauthorised advertising.
• Manipulates occupancy information, points, ratings, votes, or reliability indicators.
• Interferes with the security, integrity, availability, or operation of Bova.
• Attempts to access another user's account or restricted systems.
• Uses automated tools to scrape, extract, or collect Bova data without our written permission.
• Reverse engineers or attempts to discover the source code of Bova except where applicable law expressly permits it.
• Violates applicable law or the rights of another person.

Reports represent users' observations and opinions. They are not statements or guarantees made by Reactor Studio d.o.o.

We may review, restrict, hide, or remove User Content that we reasonably believe:

• Violates these Terms.
• Is illegal or infringes another person's rights.
• Creates a safety, privacy, fraud, or security risk.
• Is misleading, outdated, irrelevant, or harmful to the reliability of Bova.
• Must be restricted under a legal or regulatory obligation.

We may use automated signals and manual review to identify potential violations. A reliability score or disagreement between reports may inform our review, but it does not necessarily prove that a report is false.

When required by applicable law, we will explain a decision to restrict or remove content and identify the available method for challenging that decision.

We will apply our content restrictions in a diligent, objective, and proportionate manner, taking account of the rights and legitimate interests of affected users.

You can report content through the reporting or contact features available in Bova or by emailing support@bova.live.

A report should identify:

• The content concerned and where it appears.
• Why you believe it is illegal or infringes your rights.
• Any supporting information reasonably available to you.
• Your name and email address, except where the law permits anonymous reporting.
• A statement that the report is submitted in good faith and is accurate to the best of your knowledge.

We may request additional information where reasonably necessary to assess the report.

Submitting knowingly false, abusive, or misleading notices may itself violate these Terms.

We may warn you, restrict features, remove content, suspend your account, or terminate your access if we reasonably believe that:

• You have materially or repeatedly violated these Terms.
• Your account or activity creates a legal, safety, fraud, privacy, or security risk.
• You have manipulated reports, ratings, points, or other community features.
• We are required to act by law, court order, or a competent authority.
• Continuing to provide the Service to you is no longer reasonably possible.

Where appropriate, we will consider the nature, frequency, seriousness, and consequences of the conduct before acting.

We may take immediate action without advance notice where reasonably necessary to address unlawful content, serious abuse, fraud, security threats, danger to users, or another urgent risk.

Unless prohibited by law or necessary to protect an investigation, we will provide the reason for a suspension or termination and explain how you may challenge it.

You may appeal through the in-app contact form or by emailing support@bova.live. We will review appeals fairly and within a reasonable time.

You may stop using Bova and delete your account at any time.

Bova—including its software, design, branding, logos, databases, text, graphics, and content supplied by us or our licensors—is owned by or licensed to Reactor Studio d.o.o. and is protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, and revocable right to use Bova for its intended purpose.

This right does not allow you to:

• Copy, sell, sublicense, or commercially exploit Bova.
• Use Bova's branding without permission.
• Extract or republish substantial parts of Bova's content or databases.
• Create a competing database or service using Bova data.
• Remove copyright, trademark, or ownership notices.

Nothing in these Terms transfers ownership of Bova or our intellectual property to you.

Bova may use or display information and services supplied by third parties, including maps, weather information, authentication providers, notification services, app stores, device platforms, and external links.

Third-party services may be governed by their own terms and privacy policies. We do not control every third-party service and are not responsible for failures or changes outside our reasonable control.

Third-party weather, map, and destination information may be delayed, incomplete, or inaccurate and remains subject to the maritime safety notice in Section 5.

We aim to keep Bova useful and available, but we do not guarantee uninterrupted or error-free operation.

Bova may be unavailable because of maintenance, updates, network failures, third-party failures, emergencies, security incidents, or circumstances outside our reasonable control.

We may add, change, suspend, or discontinue features for valid reasons, including:

• Improving functionality or security.
• Responding to legal or regulatory requirements.
• Addressing misuse or technical limitations.
• Replacing third-party services.
• Developing or changing our business.

Where a change materially reduces the Service or affects your contractual rights, we will provide reasonable notice where practicable.

Bova is currently provided free of charge.

We may introduce optional paid features in the future. We will clearly disclose the price, billing period, renewal terms, cancellation conditions, and other applicable conditions before you agree to purchase anything.

A change to these Terms alone will never create an obligation for you to pay. We will not charge you without your express agreement.

Purchases made through Apple, Google, or another platform may also be subject to that platform's payment and refund terms.

Nothing in these Terms excludes or limits rights that cannot legally be excluded or limited, including mandatory rights available to consumers under Croatian or European Union law.

If Bova does not operate as described, you may have statutory remedies relating to digital services. These rights apply independently of any additional commitments made in these Terms.

You are responsible for how you use Bova and for decisions you make based on information available through the Service.

To the extent permitted by law, we are not responsible for loss resulting solely from:

• Treating community reports as guaranteed or verified information.
• Using Bova as a substitute for official navigation, weather, safety, or emergency information.
• Incorrect information submitted by another user.
• Failure to maintain suitable connectivity, device settings, charts, equipment, or safety procedures.
• Third-party services or events outside our reasonable control.

We do not exclude or limit liability where doing so would be unlawful. In particular, nothing in these Terms excludes liability for intentional misconduct, gross negligence, death or personal injury caused by our fault, fraud, or mandatory consumer rights.

Any limitation in these Terms applies only to the extent permitted by applicable law and must be interpreted consistently with your statutory rights.

Our Privacy Policy explains how we collect, use, share, retain, and protect personal data when you use Bova.

You can review the Privacy Policy in the app or on our website.

We may update these Terms for valid reasons, including changes to Bova, applicable law, security requirements, or our business.

The current version will be available in the app and on bova.live, with its effective date.

If a change materially affects your rights or obligations, we will provide reasonable advance notice through the app, email, or another appropriate method. Where required by law, we will ask you to accept the updated Terms.

Changes will not apply retroactively unless required by law.

If you do not agree to an updated version, you may stop using Bova and delete your account before the updated Terms take effect.

These Terms are governed by Croatian law.

If you are a consumer, this choice does not deprive you of mandatory protections provided by the law of your country of residence.

Please contact us first through the in-app contact form or at support@bova.live so we can try to resolve a complaint directly.

Any dispute will be submitted to the court having jurisdiction under applicable law. Nothing in these Terms restricts a consumer's right to bring a claim before another court that has mandatory jurisdiction.

If any part of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Our failure to enforce a provision immediately does not waive our right to enforce it later.

You may not transfer your account or your rights under these Terms to another person without our permission. We may transfer our rights and obligations as part of a merger, reorganisation, sale, or transfer of Bova, provided this does not reduce your mandatory rights.

These Terms, together with the Privacy Policy and any additional terms expressly presented for a particular feature, constitute the agreement governing your use of Bova.
